The Clinical Laboratory Price Transparency Act of 2023 was referred to the U.S. House Ways and Means Subcommittee this week.
If passed, HR 4882 will require providers of certain laboratory services under Medicare to publish their prices online as of January 1, 2025. Specifically, providers must publish and update at least annually the discounted cash price or gross charge (as applicable) for their services and, if required by the Centers for Medicare and Medicaid Services (CMS), the minimum and maximum negotiated rates between the provider and insurers, according to a brief summary.
The bill applies to clinical diagnostic laboratory tests that are included in the list of shoppable services in CMS regulations, excluding advanced diagnostic laboratory tests. Providers that fail to comply with these requirements may be subject to civil penalties.
The term "applicable laboratory" has the meaning given such term in section 414.502, of title 42, Code of Federal Regulations (or any successor regulation), according to the bill's current text.
